Forum Volume 19, Issue 3

 

This is a special issue dedicated to Insite and the Insite. case. Insite is a supervised safe injection site for illegal drug users in Vancouver's Downtown Eastside. It has been granted an exemption that protects staff and patients from prosecution for possession of illegal substances under the federal Controlled Drugs and Substances Act. However, in 2008, the federal government declined to extend the exemption. As a consequence, Insite organizers and clients brought an action against the federal government and the case has now reached the Supreme Court of Canada. It will be heard on May 12, 2011.

Volume 19, Issue 3, contains a series of papers that were generated in the context of a pedagogical encounter at the University of Victoria, one that had students and faculty engaged in a collective exploration of the Insite case. Part 1, "Insights on Insite", offers a series of comments on contextual, substantive and jurisprudential questions raised by the case. Part 2, "Some Pedagogical Insights", offers comments on the use of the Insite case to teach Legal Process.
